The Central government in its affidavit filed with Delhi High Court on Friday said Twitter’s latest appointments of chief compliance officer, nodal officer, resident grievance officer for India are in compliance with the new Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
“Twitter has clearly acknowledged that the said personnel (Chief Compliance Officer, Nodal Contact Person, and Resident Grievance Officer) are appointed as Twitter’s employees and not as ‘contingent workers’,” the affidavit acknowledged.
The San Francisco, California-based social media company also provided the names of the said appointed personnel and their respective positions. The affidavit further mentioned the employment start date of the appointees as August 4, 2021, adding that Twitter has further enclosed their employment contracts along with the said affidavit as proof of such appointments.
The government reiterated that the tech company should comply with all new IT rules.
“I submit that the IT Rules, 2021, is a law of the land. Twitter is mandatorily required to comply with the IT Rules 2021 in its entirety,” the affidavit read.
It further said that any non-compliance in adhering to the provisions of India’s new IT rules would lead to Twitter losing its immunity as content aggregator conferred under the Act against offending posts.
